These Terms of Service ("Terms") govern your access to and use of the Art Xcellence website, registration portal, student platform, and related services (collectively, the "Services") operated by Art Xcellence, Pune, Maharashtra, India ("Art Xcellence", "we", "us", or "our").

By registering for an account, purchasing a plan, or using our Services, you agree to these Terms. If you do not agree, please do not use the Services.

1. Eligibility

Art Xcellence provides developmental art assessment services for children aged 4 to 12. Accounts may be created by parents, guardians, or authorised adults on behalf of a child. You confirm that you are at least 18 years old and legally permitted to enter into this agreement.

2. Services

Art Xcellence offers teacher-reviewed developmental art assessments based on the ACIF framework. Services may include task assignments, artwork submission, assessment reports, progress tracking, and delivery of reports through channels such as WhatsApp, depending on your selected plan.

We may update, improve, or modify features of the Services from time to time. Assessment outcomes are educational and developmental in nature and are not medical, psychological, or clinical diagnoses.

3. Accounts and registration

You agree to provide accurate registration information, including name, mobile number, email address, and the child's age. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

We may suspend or terminate accounts that contain false information, violate these Terms, or are used in a manner that harms the platform, assessors, or other users.

4. Plans, billing, and free trial

Paid plans, pricing, billing cycles, and included features are described on our website at the time of purchase. A free trial may be offered without requiring payment card details, subject to availability and plan limits.

Subscription fees are billed according to the plan selected (monthly or annual). Taxes, if applicable, may be added as required by law.

5. Acceptable use

You agree not to:

• Submit content that is unlawful, abusive, infringing, or inappropriate
• Upload artwork or images you do not have the right to share
• Attempt to access accounts, data, or systems without authorisation
• Interfere with the operation, security, or integrity of the Services
• Misuse assessment reports for misleading or commercial purposes without consent

6. Intellectual property

The Art Xcellence brand, website content, assessment frameworks, rubrics, report formats, and platform software are owned by Art Xcellence or its licensors. You retain ownership of artwork and content you submit, but grant us a limited licence to store, process, review, and use submitted materials solely to provide the Services.

7. Reports and communications

Assessment reports are prepared by qualified reviewers based on submitted artwork and platform rubrics. Delivery times, report formats, and communication channels may vary by plan. We are not responsible for delays caused by incorrect contact details, third-party messaging platforms, or circumstances outside our reasonable control.

8. Third-party services

The Services may rely on third-party providers for hosting, messaging, analytics, or payment processing. Your use of those services may be subject to separate third-party terms.

9. Disclaimer

The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Art Xcellence disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted access or error-free operation.

10. Limitation of liability

To the maximum extent permitted by applicable law, Art Xcellence shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability for any claim relating to the Services shall not exceed the amount paid by you to Art Xcellence in the twelve months preceding the claim.

11. Termination

You may stop using the Services at any time. We may suspend or terminate access if you breach these Terms or if continued provision of the Services is no longer feasible. Provisions that by nature should survive termination will remain in effect.

12. Governing law

These Terms are governed by the laws of India. Courts in Pune, Maharashtra shall have exclusive jurisdiction, subject to applicable consumer protection laws.
